On November 7, 2011, the New Jersey Law Revision Commission released its final report relating to equitable distribution and the elective spousal share, recommending changes to both family law and probate focused statutes in order to address the “black hole” created by the death of a party in a divorce. Yet, more than six (6) years later, none of those proposed changes have been passed into law.
