NJ Supreme Court Victory
Congratulations to Cherylee Melcher on securing a significant victory before the New Jersey Supreme Court.
In a unanimous decision, the Court adopted Cherylee's argument that the amendments to the Child Sexual Abuse Act are not retroactive and apply only to claims involving "passive abusers" arising after the law's December 1, 2019 effective date.
This important decision provides meaningful clarity for school districts and other public and private entities facing claims under the amended statute. The appeal drew statewide attention, with participation from numerous amici curiae, including the Attorney General, the New Jersey Association for Justice, the New Jersey Defense Association, and the New Jersey State Bar Association.
