    Presenting Development Applications to Local Boards - Ethical and Professional Considerations

    Description: The development industry regularly appears before local planning boards to present and gain support for potential projects. It is necessary to carefully assess risks and proactively identify the legal background and technical issues to defend applications. Further, selection of pre-public hearing meetings (technical, community information/feedback) and effective conveyance of the project intent and benefits using an appropriate multi-media presentation during the public hearing process can diffuse attacks before more costly litigation is necessary. Refine skills, learn new strategies and become informed of ethical considerations to overcome the inherent challenges to obtaining community support and endorsement, particularly in light of ever-present objectors.     Description: The panel will highlight permitting issues that arise under the NJ Department of Environmental Protections' Land Use Management regulatory program, including the Flood Hazard Area Control Act rules, Coastal Zone Management rules, Freshwater Wetlands rules, and Stormwater Management rules. Also highlighted are some anticipated regulatory changes, the Waiver Rule, and the wastewater management planning process. (CLE)
