Donald R. Daines is
a partner of Hill Wallack LLP.
He is a member of the Land Use
Division which encompasses the
Land Use Litigation and
Land Use & Environmental
Applications Practice Groups. He
concentrates his practice in
litigation before the State and
Federal Courts related to complex
land use and development matters
including the procurement or
enforcement of permits and/or
approvals necessary for development.
His cases involve a myriad of issues
related to land development
including zoning; environmental;
infrastructure; federal fair
housing; forcing municipalities to
create realistic affordable housing
opportunities and related civil
rights issues. He routinely appears
before Planning Boards and Zoning
Boards in connection with large
scale developments, working
intimately with the developer and
the numerous professionals during
the pre-application phase to ‘front
load’ the application to maximize
development potential within the
regulatory framework and site
constraints.
A graduate of Indiana University,
he later obtained his Masters Degree
in Business Administration (MBA)
from the Indiana University Graduate
School of Business and his law
degree from Indiana University
School of Law. He is admitted to
practice in New Jersey, New York,
Pennsylvania, Indiana and Texas as
well as the United States Supreme
Court and various Federal Courts. He
has served as Adjunct Professor of
Business Law at Valparaiso
University School of Business.
He was Vice President and Chief
Legal Counsel to K. Hovnanian
Companies of New Jersey after which
he established the real estate
development division for Rivervale
Realty, a subsidiary of United Water
Resources. He has spent his entire
life working in the construction,
land development and real estate
industry overseeing and directing
all legal efforts pertaining to land
acquisitions, site investigation,
contract negotiation, project design
including environmental issues and
the procurement of governmental
approvals and permits at the local,
county, state and federal level.
He is on the Board of Directors
of the Land Use Law Section for the
New Jersey Bar Association and has
been a featured speaker at numerous
seminars and panels related to land
use law, development issues and how
to obtain government approvals from
various boards and agencies.
He is author of "Applying
Construction Management Principles
to the Land Use Governmental
Approval Process", New Jersey Bar
Association Land Use Law Section
Newsletter, October, 1990 addressing
the use of critical path and PERT
chart analysis software to manage
the procurement of government
permits and approvals and coordinate
the numerous outside experts and
consultants involved in obtaining
the many permits and approvals
required. While serving on various
task forces for the Council on
Affordable Housing [COAH], he
designed and created an automated
spreadsheet which he gave to and was
used by COAH for calculating the
maximum sales price of Affordable
Housing Units throughout the state.
Many of the documents prepared by
Mr. Daines regarding the
restrictions of Affordable Housing
Units were adopted as part of the
administrative regulations governing
Affordable Housing Units in New
Jersey.
