The Hill Wallack
LLP Land Use Litigation
Group pursues and
defends lawsuits arising
from zoning-related
disputes and the denial
of land use permits. Our
trial attorneys are
prominent throughout the
country for their
leadership in pioneering
new legal theories in
the field of land use
law. Our litigation has
included challenges to
zoning affecting a
client’s property; suits
to reverse the approval
or denial of a
development application
by a planning board,
zoning board or other
governmental agency;
exclusionary zoning
("Mount Laurel")
litigation; and a
variety of other
disputes that result
from the planning and
zoning processes.
Our significant strides in
exclusionary zoning litigation have
been noted by both national and
state publications, bar
associations, and trade
organizations. Our practice includes
representation of clients’ interests
before the Council on Affordable
Housing, which is responsible for
processing much of the exclusionary
zoning litigation in New Jersey, and
we have also been active in
litigating financial assessments
imposed against developers and
landowners for a variety of
governmental purposes.
We recognize that litigation
should be avoided whenever possible,
but when such a course is deemed
necessary, our attorneys will pursue
legal relief resourcefully and
aggressively.
