Hill
Wallack LLP's Insurance
Coverage Practice Group
is organized to respond to
the demands of the modern
day insurance industry,
where unique issues
involving novel causes of
action give rise to disputes
between insurers and their
policyholders with respect
to all lines of coverage.
Our core group of partners,
with over 100 years of
experience representing the
insurance industry, advises
claims handlers,
underwriters and
intermediaries in an effort
to provide cost efficient
solutions to the day-to-day
disputes involving insurers,
producers and policyholders.
Our lawyers are also called
upon on a regular basis to
utilize their vast trial and
appellate experience to
litigate in both federal and
state courts.
Our experience ranges
from the defense of PIP and
UM/UIM claims to the defense
of insurers with respect to
policyholder claims seeking
recovery of multiple
millions of dollars
including, but certainly not
limited to, claims arising
out of catastrophic
bodily injury or property
damage losses, employment liability,
intellectual property and
construction defect actions.

Virtually every issue
addressing CGL, Business
Auto, Personal Auto and/or
Homeowners policies has been
analyzed, briefed and
litigated by the
Insurance Coverage Practice
Group. We also have
extensive experience dealing
with Directors & Officers,
Errors & Omissions, Product
Recall, Employment Practices
Liability, Environmental
Impairment, Public Official
and Media Liability
coverages. These issues
arise in the context of the
duty to defend, exclusions,
additional insureds,
deductibles, retentions,
priority of coverages, and
the relationship between
primary and excess/umbrella
policies. In addition to our
experience with third party
claims, we also represent
insurers with respect to
first party property losses,
including fraud
investigations and
subrogation recovery.
To the extent that any
dispute with an insurer
involves a bad faith claim
seeking extra contractual
damages, our partners have
probably already addressed
that issue of law.
Beyond our experience
representing insurance
companies, we also represent
intermediaries in the
insurance industry,
including agents, brokers,
surplus lines agents,
wholesalers, managing
general agents, and third
party administrators.
Our attorneys in the
Insurance Coverage Practice
Group try cases before
judges, juries and
arbitrators. We have also
argued cases before the New
Jersey Appellate Division
and the New Jersey Supreme
Court, as well as the United
States District Court and
the Third Circuit Court of
Appeals. In addition to our
litigation experience, our
lawyers publish articles and
lecture to industry groups,
including the Defense
Research Institute and the
New Jersey Defense
Association.
